Terms of Service
1. The service
BenchFit grades the architecture fitness of software repositories: you upload a filtered copy of source code, we score it (A+ to F) across dimensions, gates, and risk indicators, and we return a report. Scans are deterministic static analysis. Your source is deleted the moment scoring finishes; what we retain is described in the Privacy Policy. By using BenchFit you accept these terms.
2. Plans — and who must pay
Community is free forever for individuals, with all core features. The price of free is anonymity: your handle is your public profile. Vibe is a paid individual plan; your anonymity is preserved, and tiers set your rate limits. Enterprise is the only plan permitted for commercial use.
Commercial use requires Enterprise. Any use of BenchFit by or for a company — including scanning code you develop in the course of employment or for a client — requires an Enterprise plan. Using a Community or Vibe plan commercially is a material breach of these terms and we may suspend or revoke access. Enterprise plans start at $45,000/year and are governed additionally by an order form; contact sales@bench.fit.
You may switch between Community and Vibe (a privacy and billing change). Enterprise accounts remain Enterprise; the same email may separately hold one personal account. All plans are rate-limited so the service stays fast for everyone; limits per plan are enforced by the API and stated at purchase.
3. Your code and your rights
Your code is yours. Uploading it grants us only the transient right to analyze it and return your report. We never train models on your source, never share it, and delete it when the scan completes. Report cards (scores, gate outcomes, and findings including file paths) are stored for your own use under a pseudonymous account id, and you can delete them at any time with Delete my data in your dashboard.
4. The Measurable Success Guarantee
BenchFit guarantees measurable success, as qualified here. On any paid plan (Vibe or Enterprise): if you run the BenchFit loop — scan, apply the benchfit next recommendation, re-scan — and your dashboard does not register a measurable improvement (a higher score or grade, or a newly passing gate) within thirty (30) days of your first paid scan, we will refund the fees you paid for the then-current billing period. For Enterprise, any different remedy in your order form controls.
Conditions: the guarantee applies once per account; claims must be sent to sales@bench.fit within that 30-day window from the account's registered email; improvement is measured by your BenchFit dashboard itself; the guarantee does not apply where scans were blocked by plan limits you exceeded, by misuse, or where recommendations were not applied. This refund is the sole and exclusive remedy under this guarantee.
5. Acceptable use
Don't attempt to breach, overload, or probe the service beyond your plan's limits; don't upload code you have no right to analyze; don't resell or proxy access to the scoring engine; don't misrepresent BenchFit grades or fabricate badges. API keys are yours to keep secret — anything scanned with your key is your account's activity.
6. Beta status, disclaimers, and liability
BenchFit is in active beta and evolves quickly. Except for the express guarantee in Section 4, the service is provided "as is", without warranties of any kind, and we do not warrant that grades are error-free or that the service is uninterrupted. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the twelve (12) months before the claim, and neither party is liable for indirect or consequential damages. Nothing here limits liability that cannot lawfully be limited.
7. Termination
You can stop using BenchFit at any time and remove your data with Delete my data (the key registry retains your key's issued-to name until revoked — email privacy@bench.fit). We may suspend accounts that breach these terms, with notice where practicable. Sections 3, 4 (for accrued claims), and 6 survive termination.
8. Changes and governing law
We may update these terms as the product evolves; material changes will be posted here with a new effective date, and continued use after that date is acceptance. These terms are governed by the laws of the State of California, excluding conflict-of-law rules. Contact: hello@bench.fit.
